These terms and conditions (the “Terms and Conditions”) govern the use of www.creativebalancebookkeeping.com (the “Site”). This Site is owned and operated by Janice P. Guazzo.
By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
Intellectual Property
All content published and made available on our Site is the property of Janice P. Guazzo and the Site’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.
Acceptable Use
As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:
- Harass or mistreat other users of our Site;
- Violate the rights of other users of our Site;
- Violate the intellectual property rights of the Site owners or any third party to the Site;
- Hack into the account of another user of the Site; or
- Act in any way that could be considered fraudulent.
If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.
Accounts
When you create an account on our Site, you agree to the following:
- You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
- All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.
We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.
Sale of Services
These Terms and Conditions govern the sale of services available on our Site.
The following services are available on our Site:
Monthly bookkeeping; Clean up and Catch up bookkeeping; New business set up in Xero accounting software.
Mobile Notary Service. Acknowledgments $10. Jurats $10. Verbal Oath/Affirmation $10. Travel Fees will be quoted as needed and the signer must agree to it in advance.
The services will be paid for in full.
These Terms and Conditions apply to all the services that are displayed on our Site at the time you access it. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from our Site at your own risk.
We reserve the right to modify, reject or cancel your services whenever it becomes necessary. If we cancel your services and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.
Payment Terms
We accept the following payment methods on our Site:
- Credit Card;
- Debit;
- Direct Debit; and
- Stripe.
We determine fees based on the type and complexity of the notarization, and a cost estimate will be provided to you in advance upon request. Payment for notary services is due prior to or at the time of the notarization. Your utilization of our notary services indicates your consent to these payment terms.
When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Delivery Services
We provide the option of secure transportation of notarized documents and legal materials, and will make reasonable efforts to ensure timely delivery; however, specific delivery times cannot be guaranteed. All service requests should be accurately documented, and fees will be based on factors such as distance, size, weight, and urgency. Any delays resulting from unforeseen circumstances are beyond our liability.
Cancellation, Rescheduling and No-Show Fees
We charge a fee for cancellations, rescheduling and no-shows for services we provide as follows:
Cancellation Policy:
- Notice Requirement: Clients must provide at least 24 hours’ notice to cancel a scheduled bookkeeping session or consultation.
- Cancellation Fee:
- Cancellations made within 24 hours of the appointment will incur a fee of $25 flat fee, depending on the type of service scheduled.
- Cancellations made with more than 24 hours’ notice will not incur any fees.
Rescheduling Policy:
- Notice Requirement: Clients are allowed to reschedule their appointments up to 24 hours before the session without penalty.
- Rescheduling Fee:
- Rescheduling requests made within 24 hours of the appointment will incur a fee of $10.
- There is no fee for rescheduling with more than 24 hours’ notice.
No-Show Policy:
- Definition of a No-Show: A “no-show” occurs when a client does not show up for their scheduled session and fails to notify in advance.
- No-Show Fee: Clients who fail to attend their scheduled session without prior notification will be charged the full cost of the service booked.
Payment of Fees:
All cancellation, rescheduling, or no-show fees will be automatically charged to the payment method on file or will be added to the client’s next invoice.
Exceptions:
We understand that unforeseen circumstances can occur. In case of emergencies, please contact us as soon as possible to discuss potential fee waivers or rescheduling options.
Agreement:
By booking a session with Creative Balance Bookkeeping, LLC, clients acknowledge and agree to the terms outlined in this policy.
Refunds for Services
We provide refunds for services sold we provide as follows:
Services Rendered:
- Once bookkeeping services have been completed, fees for the completed services are non-refundable. This is because bookkeeping involves time, expertise, and often the delivery of tangible financial reports or work products.
Prepaid Packages or Retainers:
- If a client has prepaid for a package of services or a retainer agreement:
- Unused hours or services may be eligible for a partial refund upon request, provided no active work has been performed against the remaining balance.
- Refunds for unused services will be calculated on a pro-rata basis, deducting any completed work or administrative fees.
Dissatisfaction with Services:
- If a client is dissatisfied with the quality of service provided:
- We encourage the client to contact us directly within 5 days of service completion to discuss the issue.
- We will review the concern and may offer options such as corrections to the work, discounts on future services, or, in rare cases, a partial refund.
Cancellation Before Service Start:
- If a service is canceled before any work begins:
- A full refund will be issued, minus any non-refundable deposits or administrative fees (if applicable).
Non-Refundable Fees:
- Certain fees, such as consultation fees or setup fees for new clients, may be non-refundable. This will be disclosed at the time of booking.
Disputed Charges:
- Clients must notify us within 5 days of the billing date if they wish to dispute a charge. We will work to resolve the issue promptly, but disputes submitted beyond the specified time frame may not be eligible for resolution.
How Refunds Are Issued:
- Approved refunds will be issued to the original payment method within 10 business days of approval.
Agreement:
- By engaging in our bookkeeping services, clients agree to abide by the terms outlined in this refund policy.
Consumer Protection Law
Where any consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
Links to Other Websites
Our Site contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.
Limitation of Liability
Janice P. Guazzo and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Janice P. Guazzo and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
Applicable LawThese Terms and Conditions are governed by the laws of the state of North Carolina.
Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
